Employee Appeal Process

SUBMITTING AN EMPLOYEE APPEAL:

An employee, the appellant, initiates the appeal process by completing the Employee Appeal Intake Form.

The appellant has the burden of proving their case and shall upload a copy of the adverse action being appealed and all relevant documentation and evidence upon submission.  The appeal review process will not proceed without a copy of the action on appeal.

REVIEW PROCESS:

Acknowledgement - An appeal acknowledgement is sent to the appellant within 48 hours of receipt.

Formal Records Request - A formal records request is issued to the party who issued the decision on appeal and any appropriate office(s).

Rebuttal Process:  A summary of the documents is provided to the appellant to provide transparency with information that will be considered. The appellant is provided three (3) business days to respond in writing to any dispute of fact or presentation of evidence.

Analysis:  A thorough review of the appeal on the written record will occur unless there is a compelling reason to conduct a virtual hearing due.

Determination:  Within 30 business days, the Office of Appeals and Hearings will issue a written determination that will either uphold, remand or reverse the decision on appeal. This time frame may be extended for good cause to ensure integrity and completeness of the process.
